1. Agreement
These terms and conditions apply to all groundwork services provided by Digger T (operated by Anthony Law). By accepting a quote or instructing us to proceed with work, you agree to these terms.
2. Quotations
All quotes are provided free of charge and are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on the information available at the time of assessment. If ground conditions differ from those anticipated, we will discuss any changes in scope and cost before proceeding.
3. Scope of Work
The scope of work is defined in our written quote. Any additional work requested during the project will be discussed and agreed upon before being carried out, with any cost implications communicated clearly in advance.
4. Access & Site Conditions
You agree to provide reasonable access to the work area. You confirm that you have the necessary permissions, consents, and rights to carry out the proposed works on your property. You are responsible for identifying and notifying us of any underground services, utilities, or hazards on your property.
5. Payment Terms
Payment terms are specified on each quote. For larger projects, stage payments may be required. Final payment is due upon completion of the agreed works. We reserve the right to charge interest on overdue payments at 4% above the Bank of England base rate.
6. Cancellation
You may cancel agreed works by providing written notice. If cancellation occurs after materials have been ordered or work has commenced, you may be liable for costs reasonably incurred up to the point of cancellation.
7. Guarantee
All workmanship is guaranteed for a period specified in your quote. This guarantee covers defects in workmanship only and does not cover natural settlement, ground movement, damage caused by third parties, or normal wear and tear.
8. Insurance
Digger T carries comprehensive public liability insurance and employer's liability insurance. Certificates are available on request.
9. Liability
Our liability is limited to the value of the contracted works. We are not liable for indirect or consequential losses arising from the works, delays outside our control, or damage to underground services not disclosed to us prior to commencement.
10. Disputes
In the event of a dispute, both parties agree to attempt resolution through direct communication. If a resolution cannot be reached, the dispute may be referred to mediation or the relevant courts of England and Wales.
